Host-it-planet.com ("The Company") agrees to furnish services to the Subscriber, subject to the tos.

UNMETERED DETAILS: Each UNMETERED server is connected to a Full-Duplex 10MBPS or 100MBPS switch port, which is connected to a bandwidth pool shared by each specific type of UNMETERED clientele. 10MBPS UNMETERED servers on average can transfer between 2000GB-3000GB per month in both outbound and inbound directions. 100MBPS UNMETERED servers on average can transfer between 3000GB-5000GB per month outbound and 15000GB-20000GB inbound. The bandwidth allocation is not guaranteed/dedicated, and is supplied on a "best-effort" basis---which may result in some slowdowns during peak traffic times. NO OVERAGE FEES REGARDLESS OF USAGE.
A Violation of any of the below Terms of Service will result in action by Host it planet up to and possibly including the termination of your account, with or without warning.
Host it planet is a private service which provides web hosting. Host it planet reserves the right to cancel any account for any reason or no reason at all.
Host it planet provides web hosting to any site that abides to our terms and conditions. Host it planet reserves the right to change the terms and conditions at any time. Host it planet users are entirely liable for all activities conducted through your account.
The following rules apply while using Host it planet services:
Obscene, graphically violent, and other inappropriate content is strictly prohibited. Only legal adult content is allowed.
Host it planet is not responsible for the content of any member homepages. We reserve the right to remove any homepages that are in violation of our terms and conditions. Members will be held legally responsible for the contents of their web pages including but not limited to use of copyrighted material without the permission of the author or posting material considered indecent for minors. The use of Host it planet Homepages for illegal purposes is strictly forbidden and any homepage found to be or believed to be, in Host it planet sole discretion, violating the law may be removed without notice. Your membership will be revoked, and your purchased plans will not Be refunded if any of the following activities occur:
• Hate, Bigotry, and/or Intolerance
• Warez or Software Piracy related
• Music Piracy Related
• Hacking Related
• Making available copyrighted software which has been "cracked" (e.g., copyright protection for the software has been removed)
• Making available serial numbers for software which can be used to illegally validate or register software.
• Making available tools which can be used for no purpose other than "cracking" software.
• Spamming to promote your website
• Anything related to illegal activity
You agree to not use the Service to:
1. upload, post, email, transmit or otherwise make available any Content that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable;
2. harm minors in any way;
3. impersonate any person or entity.
4. forge headers or otherwise manipulate identifiers in order to disguise the origin of any Content transmitted through the Service;
5. upload, post, email, transmit or otherwise make available any Content that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);
6. upload, post, email, transmit or otherwise make available any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights ("Rights") of any party;
7. upload, post, email, transmit or otherwise make available any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation, except in those areas (such as shopping) that are designated for such purpose ;
8. upload, post, email, transmit or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
9. upload, post, email, transmit or otherwise make available any material that is of broadcast / streaming types.
10. interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service;
11. intentionally or unintentionally violate any applicable local, state, national or international law, including, but not limited to, regulations promulgated by the U.S. Securities and Exchange Commission, any rules of any national or other securities exchange, including, without limitation, the New York Stock Exchange, the American Stock Exchange or the NASDAQ, and any regulations having the force of law;
12. provide material support or resources (or to conceal or disguise the nature, location, source, or ownership of material support or resources) to any organization(s) designated by the United States government as a foreign terrorist organization pursuant to section 219 of the Immigration and Nationality Act;
13. "stalk" or otherwise harass another; and/or
14. upload, post, email, transmit or otherwise material for the purposes of file distribution, relay, or streaming reasons.
15. collect or store personal data about other users in connection with the prohibited conduct and activities set forth in paragraphs 1 through 14 above.
We do not allow any type of programs, software, or MP3 files on our server unless you are the full owner and have all rights to the file. Copyrighted files not belonging to users posting those files may be deleted without notice!
You and any person who has access to your account must evaluate, and bear the risk associated with, the accuracy, completeness or usefulness of any Content. Host it planet reserves the right to remove Content which is deemed in Host it planet sole discretion harmful, offensive, or otherwise in violation of the Rules or any rules or policies Host it planet has in place at the time.
You or Host it planet may terminate your Account at any time for any reason.
the host it planet service is provided to you “as is” and “as available” with no warranty. to the maximum extent permitted by law, host it planet disclaims all warranties or conditions of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose, title, non-infringement, the implied condition of satisfactory quality and implied warranties arising from course of dealing or course of performance. you acknowledge that if you rely on any information or content on the service, you do so solely at your own risk.
host it planet will not be liable for any of its services. we have the right to cancel our service at any time, and we will not be liable for any files that are lost and/or corrupted which may occur (including, for example, from a system crash, security breach, or hard disk failure). to the full extent permissible under the applicable law, host it planet shall not be liable for any direct, indirect, incidental, special or consequential damages resulting from the use or inability to use host it planet services. you agree, at your own expense, to indemnify, defend and hold harmless host it planet and its affiliates, officers, directors, employees, consultants, agents, suppliers and licensors from and against any and all third party claims, liability, damages, losses and/or costs (including but not limited to reasonable attorneys’ fees) arising from or relating to: (a) your failure to comply with these terms of use; (b) your infringement or violation of any intellectual property or other right of a third party; or (c) your violation of any applicable law.
4.) Payment Information
a. You agree to supply appropriate payment for the services received from us, in advance of the time period during which such services are provided. You agree that until and unless you notify www.host-it-planet.com of your desire to cancel any or all services received, those services will be billed on a recurring basis.
b. We reserve the right to change the monthly payment amount and any other charges at anytime.
5.) Backups and Data Loss
a. Your use of the service is at your sole risk. We are not responsible for files and data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on our servers.
6.) Cancellation and Refunds
a. We reserve the right to cancel the account at any time. We do not offer refunds for breech of tos.
b. Customers may cancel at any time. We give you an unconditional 30 day money back guarantee on managed shared hosting, and reseller solution's. Refund requests after 30 days will be refused.
7.) Resource Usage
Users may not initiate the following:
a) Use 25% or more of system resources for longer then 90 seconds. There are numerous activities that could cause such problems; these include: CGI scripts, FTP, PHP, HTTP, etc.
b) Run any type of interactive real-time chat applications that require server resources. Remotely-hosted services are fully allowed.
c) Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD.
d) Run any software that interfaces with an IRC (Internet Relay Chat) network.
e) Run any gaming servers such as counter-strike, half-life, battlefield1492, etc
8.) Bandwidth Usage
a. You are allocated a monthly bandwidth allowance. This allowance varies depending on the hosting package you purchase. Should your account pass the allocated amount we reserve the right to suspend the account until the start of the next allocation, suspend the account until more bandwidth is purchased at an additional fee, suspend the account until you upgrade to a higher level of package, terminate the account and/or charge you an additional fee for the overages. Unused transfer in one month cannot be carried over to the next month.
9.) Money back Guarantee
a. On dedicated servers, and collocation no full refund will be honored, the 30 day money back guarantee does not apply. We reserve the right to refund a prorated amount or no refund at all., If you Break the tos then no refund will be given
If your site is down more than
20% of any month we reserve the right to give
you credit or for your remaining months you
signed up with, at our discretion
Late payments & Fees. All payments that are due
and not received on the specified date of
invoice will have 3 days to pay invoice. If
payment is still not received after the 1st late
day then a $5.00 late charge will be added on to
the total price for that month. If payment is
not received within 3 days then your account
will be terminated without notice.
10.) Price Change
a. The amount you pay for hosting will never
increase from the date of purchase. We reserve
the right to change prices listed on our site,
and the right to increase the amount of
resources given to plans at any time.
11.) Indemnification
a. Customer agrees that it shall defend,
indemnify, save and hold us harmless from any
and all demands, liabilities, losses, costs and
claims, including reasonable attorney's fees
asserted against us, its agents, its customers,
officers and employees, that may arise or result
from any service provided or performed or agreed
to be performed or any product sold by customer,
its agents, employees or assigns. Customer
agrees to defend, indemnify and hold harmless
any liabilities arising out of; (1) any injury
to person or property caused by any products
sold or otherwise distributed in connection with
us; (2) any material supplied by customer
infringing or allegedly infringing on the
proprietary rights of a third party; (3)
copyright infringement and (4) any defective
products sold to customers from
www.host-it-planet.com's server.
12.) Disclaimer
a. We will not be responsible for any damages
your business may suffer. We make no warranties
of any kind, expressed or implied for services
we provide. We disclaims any warranty or
merchantability or fitness for a particular
purpose. This includes loss of data resulting
from delays, no deliveries, wrong delivery, and
any and all service interruptions caused by us
and our employees.
13.) Changes to the TOS
These terms are subject to change at any time

14.) PHP Files
a. PHP file's uploaded in attempt to steal root
access will be logged and may result in a loss
of hosting with no refund payment
